Athletics: Caster Semenya Case – Further Legal Developments!

By Prof Dr Ian Blackshaw In an appeal by the Olympic 800 metres champion, Caster Semenya, to the Swiss Federal Supreme Court against the controversial CAS Decision last month, the Court has granted her, on 3 June 2019, a temporary suspension. This will allow her to compete without taking testosterone-reducing medication as required by new rules in Athletics, which apply to certain female athletes (see the CAS Media Release of 1 May 2019 reproduced on the GSLTR website). The suspension applies until 25 June 2019, by which date the IAAF, the World Governing Body of Athletics, must respond to the Court on the CAS Decision. The IAAF has said that it will seek a “swift reversal” of the Court’s suspension to avoid “serious confusion” and to “protect the integrity of the sport.” The IAAF also said that the suspension applies only to Caster Semenya and that it rejects allegations that its new rules enforce gender inequality, claiming, on the contrary, that they have been introduced to protect the rights and opportunities of female athletes.
